ABOUT THESE TERMS OF USE & PRIVACY POLICY

These Terms of Use, together with the Privacy Policy constitute a legally binding agreement between you and Nadiya Shah, Nadiya Shah Superstar, Synchronicity University and Synchronicity Publications. The content available through the Superstar space, along with other elements of the Superstar Space, including its features, user interface, software, server and all associated mobile versions, websites (such as https://nadiyashahsuperstars.com), and other technology platforms, are referred to collectively in these Terms as the “Superstar Space”. The Superstar Space provides you with access to the Content via the Internet to compatible devices. References to "You" in these Terms may also include any "Authorized User" you give access to.

In these Terms of Use and in our Privacy Policy you will know how we treat your personal information and how we communicate with you. Your access or use of the Superstar Space (nadiyashahsuperstars.com), use of nadiyashah.com, synchronicityuniversity.com & synchronicitypublications.com confirms that you have read, understood and accepted this Agreement and on behalf of any of your Authorized Users.

We operate the following websites, nadiyashah.com, nadiyashahsuperstars.com, synchronicityuniversity.com & synchronicitypublications.com. If you choose to use any of the services offered through these websites, then you agree to the collection and use of information in relation with this policy. We will not use or share your information with anyone.

INFORMATION COLLECTION AND USE
For a better experience while using our websites, we may require you to provide us with certain personally identifiable information, including but not limited to your name, email and address (only for physical orders). The information that we collect will be used to contact or identify you, or to ship your products.

LOG DATA
We want to inform you that whenever you visit our websites, we collect information that your browser sends to us. This Log Data may include information such as your computer’s Internet Protocol ("IP") address, browser version, pages of our Service that you visit, your location, the time and date of your visit, the time spent on those pages, and other statistics.

Our websites don't collect "cookies".

PAYMENT PROCESSORS
We employ third-party companies to process payments. PayPal & Stripe. We want to inform our users that these third parties have access to your Information. However, they are obligated not to disclose or use the information for any other purpose.

CHILDREN'S PRIVACY

Our Services do not address anyone under the age of 18. We do not knowingly collect personal identifiable information from children.

SETTING UP YOUR SUPERSTAR ACCOUNT AND MEMBERSHIP
- WHO CAN SUBSCRIBE TO SUPERSTAR

You must meet the following criteria to subscribe to Superstar

Be at least 18 years old, or the legal age of majority in your state or Province. If you are below this age, you may use the Platform only as an Authorized User and under the supervision of a legal guardian over the age of 18.

CREATING YOUR SUPERSTAR ACCOUNT AND PURCHASING A MEMBERSHIP

- STEPS TO CREATE A SUPERSTAR ACCOUNT

To access the Superstar Space you must have an active Superstar account, with a valid Payment Method (PayPal balance, Credit or Debit card), handled through a third party that has been authorized as the "Payment Processor" (PayPal & Stripe). By providing a Payment Method to the Payment Processor, you agree and authorize them to charge the applicable Membership fee on a monthly recurring basis, until you cancel your Membership. Unfortunately, for security reasons, your Payment Method can't be edited by us or inside the Superstar Space, so if your Payment Method's information changed, you can cancel you current membership and sign up again from scratch, using the new Payment Method. Our Payment Processors will attempt to verify the Payment Method you provide, and may do this by processing an authorization hold, which is a standard practice, however any hold will be refunded right away. Some financial institutions will hold the authorization longer, so you may want to check with your financial institution directly if you don't see the hold back in your account right away. If your Payment Method expires and you don't cancel your Membership before it renews, the platform will cancel your Subscription automatically, ending your benefits right away as well.

We offer multiple Membership plans to access the Superstar Space. The pricing and benefits for Memberships to the Superstar Space may vary, and may change over time without notice. Each Membership plan may offer different Content, e.g. Consultations, Special Horoscopes, Weekly Videoscopes, Class Passes, etc. or have certain conditions, limitations and restrictions, which are included on this page https://www.nadiyashahsuperstars.com/choose-membership.

You can change your Membership from one plan to another. However, you will need to cancel your current plan first by going to the "My Subscription" page inside the Superstar Space. Then you will need to sign up again to the new plan from scratch by going here https://www.nadiyashahsuperstars.com/choose-membership. Our Assistance team is unable to do this process for you on your behalf.

AUTHORIZED USERS

Once you create a Superstar account, you will have the responsibility of preventing access by unauthorized users, by keeping your password secure, and by changing it from time to time. The content available in the Superstar Space is not produced with children in mind. Therefore, minors can only be Authorized Users under the supervision of a parent or legal guardian in order to help control the Content they are allowed to view in the Superstar Space. You are responsible for monitoring your minor child at all times while using the Superstar Space.

You are responsible for all activity under your Superstar Account, including the devices that are used to access the Superstar Space. You are responsible for maintaining the confidentiality of your Superstar account email and password. In addition, to prevent unauthorized access to your Superstar Account, you must maintain control over the devices used to access the Superstar Space, not permit any unauthorized user to access your Superstar Account, and not reveal your email and password or Payment Method to anyone.

MEMBERSHIP FREE TRIALS

The Superstar Space may be made available on a free trial basis for a limited time on a Trial Membership. The duration of each Trial period will be specified at sign-up. Trial Memberships are limited to new Superstars only, unless otherwise specified.

At the time of signing up for a Trial Membership, you must provide a valid Payment Method in order to use the Superstar Space during the Trial period. Your Payment Method will not be charged during the Trial period.

UNLESS YOU CANCEL YOUR TRIAL SUBSCRIPTION BEFORE THE RENEWAL DATE, UPON ITS EXPIRATION, THE MEMBERSHIP FEE FOR WILL BE CHARGED IN FULL TO YOUR PAYMENT METHOD.

After your Trial period ends, the Payment Processor will begin billing you using your Payment Method at the regular Membership Fee unless you cancel before the offer period ends. We will not notify you that your Trial period is about to end. IMPORTANT: No refunds, adjustments or credits will be applied to Trial Memberships. New customers may take advantage of any Trial Membership only once. Requirements for a Free Trial will be stated at the time each offer is presented. Eligibility will be determined at our sole discretion, and we reserve the right to revoke Trial Memberships in the event that we determine you are not eligible.

You agree not to register multiple times for Trial Memberships using multiple names, email addresses or other means. If you do so, you will be in violation of our terms. We may monitor IPs from time to time, and any accesses created under the same IP or under the same information will be canceled. We may hold the right to block you from Subscribing again.

PAYMENT AND BILLING

RECURRING BILLING

By creating an account and providing a Payment Method, you agree to pay the Membership Fee every month. The Payment Processor will charge the Membership Fee to your Payment Method on the same date of your Membership purchase. After that, the Membership Fee will be charged to your Payment Method by the Payment Processor on a recurring basis, every month.

BILLING CYCLE

The Membership Fee will be billed at the time you establish your Membership on a monthly recurring basis unless you cancel your Membership before the end of your cycle. Please note that the length of your billing cycle will be of 30 days, unless specified otherwise on a Trial Membership. You can go to the "My Subscription" page inside your Superstar account to see your next billing or expiration date. If there happens to be a problem with your Payment Method, such as an expired credit card, your account will be canceled right away.

MEMBERSHIP PRICE OR BENEFIT CHANGES

We may change the price or benefits for a Membership at any time. We will communicate any price or benefits changes to you via email.

YOUR RIGHT TO CANCEL

You can cancel your Superstar membership at any time. HOWEVER, YOU MUST CANCEL YOUR SUBSCRIPTION BEFORE IT RENEWS IN ORDER TO AVOID BEING CHARGED FOR THE NEXT MEMBERSHIP FEE. If you cancel your Membership before the end of your cycle, the cancellation will become effective at the end of the billing period and you will continue to have access to the Superstar Space until the end of that cycle.

NO REFUNDS POLICY

WE DO NOT PROVIDE REFUNDS FOR ANY MEMBERSHIPS; NOR DO WE PROVIDE CREDITS, OR PRORATED BILLING FOR SUBSCRIPTIONS THAT ARE CANCELLED.

We don't provide refunds or credits for any partial membership periods or unused Superstar content.

SYNCHRONICITY UNIVERSITY/ NADIYA SHAH DIGITAL PRODUCTS (CLASSES, SPECIAL HOROSCOPES, ETC.)

Products you purchase digitally at synchronicityuniversity.com and nadiyashah.com are non-refundable.

Since our digital products available for sale are intangible, there is a strict NO REFUND policy.

Delivery of Purchased Digital Products
If you do not receive the digital product link upon purchasing, you can immediately contact us at contact@nadiyashah.com or info@synchronicityuniversity.com with your transaction/payment details to ensure your product is delivered as soon as possible.

We may offer refunds, discounts or other considerations, only as a courtesy. However, each circumstance will be uniquely evaluated and election to make such an offer in one instance does not create the obligation to do so in another.

We reserve the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product or service offerings without prior notice.

YOUR USE OF THE SUPERSTAR SPACE

SYSTEM AND COMPATIBILITY REQUIREMENTS

To use the Superstar Space, you will need to use a desktop, laptop or mobile device. Features and functionalities that we make available through the Superstar Space may differ by device. We may change or stop support of any hardware or software platforms at any time. In order to access the Superstar Space, you need a high-speed internet connection for your compatible device. The use of the Superstar Space may count towards your data usage, depending on the terms of your internet service provider or mobile data plan. From time to time the Superstar Space may be unavailable for any reason, including, without limitation: (a) server malfunctions; (b) maintenance procedures; or (c) causes beyond the control of Nadiya Shah and her team.

CONTENT LIMITATIONS AND DOWNLOADS

CONTENT LIMITATIONS

The Content may have an access window in which you will be able to view the Content. Access windows will vary, but are usually of 2 or 3 months after the Content is published. During the access window, you will be able to view the Content as many times as you want, BUT ONCE THE ACCESS WINDOW FOR A PARTICULAR CONTENT ITEM ENDS, YOU WILL NO LONGER BE ABLE TO ACCESS THAT CONTENT. Access to any Content can be disabled at any time, with or without notice, regardless of the access windows or programming schedules.

The viewing quality of Content, including resolution and the time it takes to start playing Content, may be affected by the format of the Content, your location, the speed and bandwidth of your internet service, and the devices used, among other factors, such as HD availability, internet service and device capabilities. With that being said, we do not guarantee the accessibility of any particular Content at any time. If you experience any playback issues, our development team will help you as much as possible, to remedy the situation, so if that were to happen, you can reach out to us for assistance at contact@nadiyashah.com

DOWNLOADS

Downloading ALL Content at NadiyaShahSuperstars.com, NadiyaShah.com, Synchronicity University & Synchronicity Publications is forbidden, unless these are classes your purchased or signed up to at Synchronicity University.

If you signed up to Synchronicity University classes make sure you download the Content of your classes within 3 months. Once this time has passed, you may not be able to find the links to download the classes. Access to these download links is only as part of your purchase. You don't have the right to distribute or sell these links.

The Content in the Superstar Space does not contain advertising. However, Nadiya Shah and her affiliates may show third-party advertisers, products or services through any of her websites. Nadiya Shah, her affiliates and employees will not take responsibility for any such third-party advertisers, products or services. Any interactions you may have with an advertiser will be between you and such advertiser. If you engage in any transaction with an advertiser Nadiya Shah has shown anywhere through her websites, including providing that advertiser with any personal Information with your consent, you agree that Nadiya Shah will not be responsible for such transaction or provision of personal information and you further agree that Nadiya Shah is not liable for any claim or loss that may result from your engagement with any advertiser or third party company.

UPDATES

We may choose to make available updates, bug fixes, or other changes or enhancements to the Superstar Space. By subscribing, you consent to all Service Updates without further notice.

Updates may be

(a) Automatic, such as in connection with general website changes and additional features or updates;

(b) Your choice, in which case you will receive information on how to authorize optional Updates via email; or

(c) Mandatory, in which case you will be required to consent to the Update or install or upgrade third-party plug-ins to maintain access to the Superstar Space.

* Please note that the Superstar Space may be unavailable during any platform Update.

CANCELLATION AND TERMINATION:

We may cancel, suspend, disable or terminate your Membership and access to the Superstar Space and your Account immediately for any reason, including if we determine that you have provided inaccurate account or payment details, or you are otherwise in violation of these Terms. If this occurs, you won't be able to use your Account. If we disable your Subscription and/or access to all or any part of the Superstar Space, you agree not to create another Account or try to access the Superstar Space without our permission.

If you have reason to believe that your Account credentials have been compromised or misappropriated in some way, call us or email us right away!

PROMOTIONAL EMAILS

By using the Superstar Space, or by subscribing to Nadiya Shah's Newsletter service, you acknowledge that we can send you emails, push notifications or other electronic service communications about your account. You also consent to receive electronic promotional messages, offers, surveys, and other materials. You understand that emails may be generated by automatic senders, such like Mail-chimp. Agreeing to receive these promotional emails is not a condition of purchasing any goods or services. If at any time you no longer want to receive promotional communications, you can opt out by either:

- Unsubscribing by clicking on the link at the bottom of the electronic communication
- Or by sending us an email at contact@nadiyashah.com.

Please note: Changes made to email settings may not take effect immediately, and there could be a delay before the new settings become effective.

The Superstar Space, and all materials incorporated into it are protected by copyright laws. Nadiya Shah has licensed the Content for private use only and not for public or commercial exhibition. This means that you cannot show or share any Content from the Superstar Space to any public audience; Any unauthorized copying, editing, exhibition, broadcast or distribution of the Content can result in penalties under Canadian (Province of Ontario), or any other applicable laws.

Logos, videos, images, graphics, PDFs and quotes shown in the Superstar Space (at NadiyaShahSuperstars.com), at Nadiya Shah.com, SynchronicityUniversity.com & SynchronicityPublications.com, on Nadiya Shah Social Media platforms and YouTube Channel are also protected by copyright laws, and are the property of Nadiya Shah. Use by anyone else is not authorized without permission from the owner.

RESTRICTIONS ON USE OF THE SUPERSTAR SPACE

You are only authorized to access the Content in the Superstar Space for non-commercial, personal, entertainment use on compatible devices while your Membership is active, and only as permitted in these Terms. You may not: copy, reproduce, distribute, transfer, sell, license, publish, enter into a database, display, modify, create derivative works, upload, edit, post, link to, frame, transmit, rent, lease, lend, sublicense or in any way exploit any part of the Content, or attempt to interfere with the operation of the Superstar Space; use any data mining, robots, virus, worms, bugs, or other data gathering and extraction tools, or frame any portion of the Superstar Space, or attempt to tamper, hack, corrupt, or impair the administration and/or security of the Superstar Space. USING THE CONTENT OR ANY MATERIAL SHOWN IN THE SUPERSTAR SPACE, OR ON ANY NADIYA SHAH'S WEBSITES, TO UPLOAD IT OR SHOW IT ON OTHER WEBSITES, OTHER NETWORKED COMPUTERS, OTHER SOCIAL MEDIA PLATFORMS, OR OTHER YOUTUBE CHANNELS IS STRICTLY PROHIBITED.

GIVEAWAYS AND RAFFLES

IMPORTANT: In the event of raffles and giveaways, we will strive to fulfill all prizes promised; however, we cannot guarantee the availability of prizes, particularly those provided by third parties. While we will make every effort to provide an alternative prize if the original cannot be honored, we cannot assure the availability of substitutes. Please note that WE ARE NOT LIABLE for any unfulfilled prizes in such circumstances.

GIVEAWAYS ELIGIBILITY

Giveaways will be open to people of 18 years of age or the legal age of majority in their state or Province of residence. The following individuals are not eligible to enter or win our Giveaways: current or former employees and contractors of Nadiya Shah and Synchronicity University, and anyone involved in the administration of the Giveaway, and any member of the immediate family (i.e., a parent, sibling, child or grandchild) or household of any of the foregoing individuals.

GIVEAWAYS PERIOD

Each Giveaway begins and ends on the dates and times as specified on the Giveaway Social Media Posts, Website and Newsletters (the “Giveaway Entry Period”). Entries will only be accepted during the Giveaway Entry Period.

PRIZES

Prizes shall be as stated on the Giveaway Social Media Posts, Website and Newsletters. No cash substitutions are permitted WHATSOEVER. Prizes are non transferable.

Online readings shall be subject to the terms and conditions of each astrologer, and will be booked at each astrologer's discretion and schedule availability.

For book copies or deliverable items, the winners will be responsible for paying all costs and expenses including, but not limited to, shipping costs, customs fees, income taxes, and any other expenses that might reasonably be incurred by the winner in receiving or using the prize.

Each prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied. Prizes CAN'T BE TRANSFERRED, REASSIGNED, or REDEEMED FOR CASH. Nadiya Shah and Synchronicity University reserve the right to substitute a prize with another equal or similar to the value of the original place when setting up the Giveaway.

INDEMNITY

You agree to indemnify and hold harmless Nadiya Shah, subsidiaries, affiliates, partners, agents, employees and members of all of the foregoing, from and against all third party claims, losses, expenses, damages and costs, including reasonable attorney fees, resulting from your actual or alleged breach of these Terms.

DISPUTE RESOLUTION

Our Assistance Team can resolve most customer concerns quickly and to the customer's satisfaction. Please contact our team at contact@nadiyashah.com for any disputes.

In the unlikely event that we can't resolve a dispute, we each agree to resolve those disputes through binding arbitration or small claims court.

GOVERNING LAW AND VENUE

These Terms shall be governed by the laws of the Province of Ontario, CANADA without regard to conflict of law principles. We and you each irrevocably consent to the exclusive jurisdiction and venue of the Province of Ontario, CANADA.

FORCE MAJEURE

Nadiya Shah, her affiliates and employees shall not have any liability to you by reason of any delay or failure to perform any obligation under these Terms if the delay or failure to perform is occasioned by force majeure, which shall refer to any act of God, storm, fire, casualty, unanticipated work stoppage, power outage, server failure, strike, lockout, labor dispute, civil disturbance, riot, war, public health emergency, epidemic, pandemic or national emergency, Governmental action, or other cause beyond our control.

IMPORTANT: We reserve the right to modify these Terms or change any part of the Platform at any time.

By continuing to use Nadiya Shah's websites, Superstar Space and Platforms after carefully reading these Terms of Use and Privacy Policy, and in the case of any purchased products, services or memberships through her platforms, your decision not to cancel your Membership before it renews or within any relevant notice period, means THAT YOU AGREE TO BE BOUND TO ALL THESE TERMS.
